Sharp’s sale to Hon Hai of Taiwan delayed

– As reported by Nikkei Asian News newspaper
– Hon Hai Precision Industry (aka Foxconn) was unable to complete its acquisition of Sharp in June as intended, thwarted by a time-consuming antitrust review in China.
– The delay deals a blow to Sharp’s plans to install new management and start the rebuilding process quickly. 
– A Sharp insider stated that the ailing Japanese electronics giant had hoped to get the capital injection in June to bring the company’s assets above its liabilities, then put the new management structure in place July 1.
– Hon Hai Chairman Terry Gou stated at a June 22 shareholders meeting that process would be completed by the end of the month. Sharp President Kozo Takahashi also had cited June 30 as the target date.
– Sharp’s shares have plunged 25% over the past month, closing at 110 yen ($1.07) Thursday. They sank as low as 94 yen Monday, near the 88 yen per share Foxconn is set to pay.

Kyocera announces restructuring

– Kyocera (aka Kyoto Ceramic Co. of Japan) announced that it is “streamlining its operations” by shaking up management and by absorbing four of its wholly-owned subsidiaries. 
– Under the new structure, San Diego-based Kyocera International will absorb four of its wholly-owned subsidiaries and will operate their existing businesses as a single enterprise.

Hewlett Packard Enterprise wins big lawsuit

– A California jury ordered business software giant Oracle to pay Hewlett Packard Enterprise (HPE) $3 billion for backing off a promise to support data servers powered by Itanium chips.
– Oracle said it had acted properly in the situation and that it planned to appeal to a higher court.
– "Two trials have now demonstrated clearly that the Itanium chip was nearing end of life, HP knew it, and was actively hiding that fact from its customers," Oracle general counsel Dorian Daley said in a released statement. o "Five years ago, Oracle made a software development announcement which accurately reflected the future of the Itanium microprocessor."

– HPE argued that Oracle breached a contract when it decided in 2011 to stop offering products running on HP servers powered by Itanium chips made by Intel.
– Oracle contended it never believed it had a contract to indefinitely make its software work on Itanium servers, noting that HP and Intel stopped developing the systems years ago.

Xerox conducts CRD PPS open house in NY

– Xerox brought together 30 in-plant managers for a Thought Leadership Workshop at its Gil Hatch Center for Customer Innovation in Rochester, New York
– With the theme “Amp Up Your In-plant,” the day-and-a-half event began Monday with a networking reception and dinner, followed by a keynote presentation by Peter Muir, president of Bizucate.

Samsung former exec goes to prison

– A former director of Samsung America Inc.’s Korea Export Department was sentenced to 75 months in prison on Wednesday for his role in a scheme to embezzle more than $1 million from the company from 2002 through 2007.
– According to the U.S. Attorney’s Office (NJ), John Y. Lee, a/k/a "Yong Kook Lee," 53, of West New York, previously pleaded guilty before a U.S. District judge to one count of wire fraud and one count of subscribing to false individual income tax returns. 
– According to court documents and statements, during his plea hearing, Lee admitted his role in an elaborate scheme to embezzle funds from Samsung America, a Ridgefield Park-based global trading and investment company and American subsidiary of the Korean conglomerate Samsung Corp. 
– Lee admitted that in September 2000, he created a fictitious entity that he called the Engelhard Supple (sic) Co. to make it appear as though that entity was actually Engelhard Corp., a provider of metal refining services based in Iselin, prosecutors said. 
– Lee admitted creating numerous false financial documents, including invoices, purchase orders and payment applications that made it appear that Samsung Corning Precision Glass Ltd., a joint venture involving the Samsung Corporation and Corning Inc., had ordered services from Engelhard, prosecutors said.
– In fact, no real services had been ordered or provided; Lee submitted the fraudulent documents to Samsung America to induce Samsung America to wire money directly into a bank account he controlled, prosecutors stated.
– Prosecutors also said that in an effort to conceal his fraudulent conduct, Lee sent false documents to Samsung America’s accounting department. 
– In his plea agreement, Lee admitted that the loss to the company was between $1 million and $2.5 million. He also acknowledged that he signed and filed a 2006 Individual Income Tax Return that failed to include $339,138 he had embezzled from Samsung America in 2006, prosecutors said.
